HOW TO ENTER: This contest begins 12:01 a.m. Central Time (CT) December 30, 2008 and ends 11:59 p.m. CT on February 25, 2009. To enter, simply fill out the on-line entry form and answer in 100 words or less the question “What are your fitness goals for 2009?” Your submission must tell us about your goal and how you plan to achieve it. Your essay must be 100 words or less. Entry must be completed on-line. No mailed or emailed entries will be accepted. Limit one entry per person. Entries become sole property of Health magazine and none will be returned. Enter here.
JUDGING: All entries will be judged by representatives of Health magazine based upon Originality (25%); Creativity (25%); Use of language (25%); and Demonstration of entrant’s desire to live a healthy lifestyle (25%). In the event of a tie, the person among the tied entries with the highest score in Use of language will be deemed the winner. Your submission must be original and not previously published. Decisions of judges are final and binding. Health reserves the right to edit the essay for publication. Winner will be notified by email, telephone and/or mail.
ELIGIBILITY: Open to legal residents of the 50 United States and the District of Columbia who have reached the age 21 as of the start date of the contest. Void where prohibited by law. Employees of Health magazine (Health) and the American Council on Exercise (ACE) (collectively referred to as “Sponsors”), their parent corporations, affiliates and subsidiaries (and members of their immediate family and/or those living in the same of household of each such employee) are not eligible.
PRIZES: One (1) Winner will be selected. Winner will receive sixteen (16) personal training sessions with an ACE-certified trainer provided by ACE. (Retail Value $1000). In addition winning stories could be featured on Health.com.
CONDITIONS OF PARTICIPATION: Entrants agree to be bound by the terms of these Official Rules and by the decisions of Sponsors, which are final and binding on all matters pertaining to this Contest. No transfer, assignment or substitution of a prize, except Sponsors reserve the right to substitute prize for an item of equal or greater value in the event an advertised prize is unavailable. All federal, state and local laws and regulations apply. Potential Winner will be required to sign and return a Statement of Eligibility, a Liability Release and where legally permissible a Publicity Release within 7 days following the date of first attempted notification, certifying, among other things, the following: (a) the entry has not won a previous prize/award or been previously published/reproduced; (b) Entrant is not a professional writer (i.e., someone deriving 50% or more of his/her income from writing or freelancing for publication); (c) the essay is original and (d) that you grant Health the right to edit or adapt the essay as necessary for publication. Winner hereby further agrees to sign any documents necessary to transfer copyright of the essay to Sponsors within 7 days following the date of first attempted notification. Failure to comply with this deadline may result in forfeiture of the prize and selection of an alternate winner or finalist. Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner or finalist. Acceptance of the prize constitutes permission for Sponsors to use Winner’s name, likeness and/or essay, for advertising and promotional purposes without additional compensation, unless prohibited by law. By accepting prize, Winner agrees to hold Sponsors, their directors, officers, employees and assigns harmless for any injury or damage caused or claimed to be caused by participation in the contest. Sponsors are not responsible for any typographical or other error in the printing of the contest offer, administration of the contest or in the announcement of the prize.
INTERNET DISCLAIMERS: Sponsors are not responsible for lost or late entries, electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason the contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this contest, Sponsors reserve the right at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. Sponsors reserve the right to select a winner from eligible entries received as of the termination date. If there is a dispute as to the identity of the entrant, the prize will be awarded to the authorized account holder of the email address. The “authorized account holder” is defined as the natural person to whom the email address is assigned.
